By using our website (qcas.aero) and by engaging QCAS for maintenance, inspection, management, or related services (together, the “Services”), you agree to these Terms. If you’re accepting on behalf of an operator or company, you confirm you’re authorized to do so.
1. What we do
We provide aircraft maintenance and related services performed at Miami Executive Airport and, when agreed, on a mobile/AOG basis. Scope, timing, and pricing are defined in our estimates/work orders and any written amendments.
2. Estimates, approvals & changes
- Estimates are good-faith pricing based on aircraft condition and information available when issued. These do not constitute a final invoice.
- We start work upon written approval (email, portal approval, signed WO).
- If we discover additional discrepancies (common in inspections), we’ll seek your written authorization before proceeding, except where safety, regulatory, or practical reasons require immediate action (e.g., to secure the aircraft or prevent damage).
3. Scheduling, AOG & cancellations
We try hard to meet requested slots and return-to-service targets. Schedules may shift due to parts, vendor turnaround, regulatory findings, or hangar capacity.
AOG/mobile: travel time, per diem, and minimums may apply.
Cancellations/deferrals: please give notice promptly; shop time or special-order parts may incur fees.
4. Customer responsibilities
- Provide accurate aircraft info (tail, SN, time/cycles, MEL/CDL, current status) and disclose known squawks.
- Ensure logbooks/records are available for review and entry.
- Maintain aircraft insurance and airworthiness compliance not expressly assigned to QCAS.
- Remove valuables and secure loose items before maintenance.
5. Regulatory compliance & logbooks
- QCAS performs work in accordance with applicable regulations and data (e.g., FAA guidance, OEM manuals).
- We make logbook/maintenance record entries only for work we perform/verify.
- AD/SB compliance is limited to the items in the approved scope unless you engage us for a comprehensive records review.
6. Parts, materials & warranties
We source OEM/PMAd parts per your preference and availability. Lead times and pricing may change.
Special-order parts and hazmat shipping may require prepayment and can be non-returnable.
Manufacturer warranties on parts are passed through to you; labor to remove/replace under warranty may be billable unless otherwise stated.
If you provide parts, QCAS isn’t responsible for their suitability, legality, or any delays/defects they cause.
7. Quality & return-to-service
We follow documented procedures and quality checks.
Test flights, operational checks, and post-maintenance evaluations are performed per the approved scope. Operator Crew/insurance are generally required for test flights unless otherwise agreed.
8. Pricing, invoices & payment
We invoice for labor, parts, outside services, consumables, shop supplies, environmental fees, travel, and applicable taxes.
Payment terms: [e.g., Due on receipt / Net 15]. Deposits may be required, especially for large jobs or special orders.
Late payments may incur interest/late fees as allowed by law.
QCAS may retain a mechanic’s lien and hold logbooks/aircraft until balances are paid.
9. Storage & abandonment
Storage fees may apply for aircraft left beyond [X] days after job completion or invoice due date.
After reasonable notice, we may take action permitted by law for abandoned aircraft/parts.
10. Site use (qcas.aero)
The website content is for general information only and may change.
Don’t misuse the site (e.g., security probing, scraping, unlawful activity).
All **IP—logos, copy, photos, PDFs—**is owned by QCAS or licensors. You may not reuse without permission.
11. Privacy & communications
When you contact us or request a quote, you share information we use to respond and perform the Services. See our Privacy Policy for details.
You consent to receive service-related emails, texts, or calls. You can opt out of marketing anytime.
12. Third-party vendors & links
We may work with specialized vendors (e.g., avionics, NDT, machining) and link to external resources. We’re not responsible for third-party sites or services outside our control.
13. Disclaimers (important)
Except as expressly stated in writing, the Services are provided “as is” and “as available.”
Aviation is technical and condition-dependent; we can’t guarantee zero future discrepancies or aircraft availability beyond the approved scope.
QCAS does not provide legal or tax advice and is not responsible for operational decisions made by the operator.
14. Limitation of liability
To the maximum extent permitted by law, QCAS’s total liability for any claim related to the Services is limited to the amount you paid to QCAS for the specific work giving rise to the claim. QCAS is not liable for indirect, incidental, special, or consequential damages (e.g., loss of use, loss of revenue, positioning costs), even if advised of the possibility.
Some jurisdictions don’t allow certain limitations; if so, they apply to the fullest extent allowed.
15. Indemnification
You agree to defend, indemnify, and hold harmless QCAS and its personnel from claims, damages, liabilities, and expenses arising out of (a) your aircraft’s operation or modification decisions, (b) materials/parts you supply, or (c) your breach of these Terms—except to the extent caused by QCAS’s gross negligence or willful misconduct.
16. Force majeure
We aren’t responsible for delays or failures caused by events beyond our reasonable control (e.g., supply-chain issues, strikes, severe weather, acts of God, regulatory actions).
17. Export, sanctions & compliance
You represent that your aircraft and transactions with QCAS comply with U.S. export controls and sanctions. You won’t direct QCAS to act in violation of applicable law.
18. Changes to Terms
We may update these Terms. When we do, we’ll change the Effective date above. Continued use of the site or Services after changes means you accept the updated Terms.
19. Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to that venue and jurisdiction. You and QCAS agree to good-faith negotiation before litigation.
